CHANGES TO MINIMUM WAGE LAWS Posting Date: December 21,
2004 By Kyle Greene of Morris Hardwick Schneider Kyle Greene of the law firm Morris Hardwick Schneider, Legal Counsel to the Georgia Association of Mortgage Brokers, has provided the following update on changes in the U.S. Department of Labor Minimum Wage Laws on behalf of the GAMB Legislative Committee. Effective August 23, 2004, the U.S. Department of Labor has significantly changed the regulations governing minimum wage requirements and exemptions. Most significant for GAMB members are the changes to the Administrative Employee Exemptions found at 24 CFR § 541.200 to § 541.203. This is the exemption applicable to the majority of employees in the financial services industry and relied upon by most mortgage brokers in determining that loan originators are exempt from minimum wage and overtime pay regulations. Under the old test, and employee qualified for the exemption if (a) paid a minimum of $250 per week, (b) had a primary duty consisting of the performance of office or non-manual work directly related to management policies or general business operations of the employer or its customers, and (c) the work included the exercise of discretion and independent judgment. Under the new test, the employee must meet the following to qualify: (a) be paid a salary of at least $450 per week, (b) have a primary duty consisting of the performance of office or non-manual work directly related to management policies or general business operations of the employer or its customers, and (c) the primary duty must include the exercise of discretion and independent judgment with respect to matters of significance. brokerage industry in Western
Pennsylvania and West Virginia,
finding numerous violations.
Penalties can be significant,
including: two years of back
wages, or three if the violation
is found to be willful; the back
wages can also be doubled if the
violation is willful; a $1,000
civil penalty per violation if
there are repeated willful
violations; attorneyıs fees and
costs; and there is the
possibility of criminal
penalties with both corporate
and individual liability for
